In short
You may embroider any design for personal use — on every plan.
With Pro, one-person businesses may sell up to 500 embroidered items a year.
With Studio, you sell without a quantity limit, employees included.
You may never pass on or sell the files themselves.
The licence belongs to one person and cannot be transferred.
This summary is for orientation. The licence text below is what applies.
Subject and scope
(1) These licence terms govern the use of designs from the NextStitch catalogue marked "NextStitch Design Licence" (the "designs").
(2) The licensor is Andreas Ebner — DeFactory (see terms § 2 and the imprint). All rights in the designs remain with the licensor or its licensors.
(3) Where a design or a font states a different licence, that licence takes precedence (terms § 8). The terms of service apply in addition.
Licensee
(1) The licensee is the natural person who owns the NextStitch account. The licence is bound to that person.
(2) The licence is not transferable. No sublicences may be granted.
(3) On the Studio plan, every person with their own team seat is a licensee to the extent of that plan.
Grant of rights
The licensor grants the licensee a simple, non-transferable right to use the designs to the extent of sections 4 to 6, in particular to embroider them and to pass on embroidered items. No further rights are granted.
Personal use
(1) On every plan, including the Pro trial, the licensee may embroider the designs for personal, non-commercial use. The Pro trial grants this personal use only; commercial use as set out under "Commercial use on the Pro plan" needs a paid Pro plan.
(2) Embroidered items may be given as gifts and passed on free of charge for charitable purposes.
Commercial use on the Pro plan
(1) On the Pro plan, the licensee may sell embroidered items, provided they run their business alone — for example as a sole trader, a freelancer or the only person in a company — and embroider the items themselves.
(2) Sales are limited to 500 items per calendar year in total across all designs. Every embroidered item counts on its own, including items within a set.
(3) The licensee is free to choose how to sell, for example at markets, in their own online shop, on online marketplaces or as commissioned work.
(4) Production by employees, by contract embroiderers or through print-on-demand and other production services is not covered.
Commercial use on the Studio plan
(1) On the Studio plan, embroidered items may be sold without any quantity limit, including by businesses with employees.
(2) The items may be embroidered by the people who are assigned their own team seat.
Excluded uses
Whatever the plan, it is not permitted
to pass on, sell, rent out or make publicly available the design files or machine files made from them, including in edited form;
to offer designs as files, templates or embroidery patterns;
to use a design as a logo, trademark or other business identifier, or to register it as one;
to use the designs to train or improve artificial intelligence systems.
Term and end of a plan
(1) The rights to commercial use under sections 5 and 6 last as long as the respective plan.
(2) Items embroidered while the plan was active may also be sold after it ends.
(3) The right to personal use under section 4 remains.
Further uses
(1) Any use beyond this licence, such as larger quantities without the Studio plan, requires the licensor's prior consent in text form. Please send requests to contact@nextstitch.app.
(2) The licensor's statutory claims in the event of use outside this licence remain unaffected.
